By accepting the terms and conditions, you acknowledge your complete agreement with this disclaimer. Especially, you grant permission to IoT vulnerability scanning application (Checkbox), offered by ACIS Professional Center Co., Ltd. (referred to as "ACIS," "we," "our," "us," or Checkbox), to conduct scans on your assets i.e., home network, and IoT devices, to gather data for analysis and to offer recommendations for addressing identified vulnerabilities.

By using Checkbox, you authorize Checkbox to perform the above actions on your IoT devices and agree to the conditions in this disclaimer. If you disagree, stop using Checkbox and its features.

User Responsibilities

1. You validate the accuracy and authenticity of the information provided for Checkbox. You assume full responsibility for any consequences if the submitted information violates the stipulated commitments or applicable laws and regulations.
2. You acknowledge and accept the risks of using Checkbox, including service disruptions, data loss, and data exposure. You agree that Checkbox is not responsible for these risks. You also promise to back up your data before using Checkbox and to only use Checkbox scanning when your system is not in use.
3. You agree that Checkbox identifies and suggests ways to fix security risks in the reports, but these suggestions are only for reference and may not solve all security issues.
4. Checkbox is committed to enhancing service quality, but it cannot guarantee that the scanning is free of defects or can detect all IoT security vulnerabilities. Checkbox is not liable for any defects or failures in IoT vulnerability scans.
5. To thoroughly scan your home network and IoT devices for vulnerabilities, you provide consent for the collection and utilization of personal or sensitive data, including usernames and passwords employed for website logins. We will only use your personal data for this purpose.

Data Storage and Security

Your usernames and passwords for the product will be stored securely until you delete them. Your information is securely saved and protected, including data encryption. Checkbox does not share, transfer, or disclose your information without your prior consent unless required by law and regulations. You have the right to access, modify, change, and delete your information. To learn more about your rights, contact us on the Checkbox website.

The storage location for the above information is within the confines of Thailand.

You are responsible for ensuring that your use of Checkbox complies with all applicable laws and regulations. Checkbox only provides the standard service as requested and is not responsible for the legal compliance of your use.

Checkbox is not responsible for delays, delivery failures, or other losses or damage caused by data transmission over communication networks and facilities, including the Internet. The client agrees that Checkbox may experience limitations, delays, and other inherent issues related to the use of such communication facilities.

Authorized Usage

You are authorized to utilize Checkbox exclusively under the following conditions:

1. Consumer Usage: You may access and use Checkbox if you are an individual consumer, not engaging as a business user. This is strictly for non-commercial and personal purposes.
2. Business Usage: Business users are permitted to access and use Checkbox for internal operations only. They must follow terms and conditions, as well as any terms from third-party service providers associated with the device through which the application is accessed or utilized. All usage must be in accordance with lawful regulations and undertaken responsibly.
3. Lawful Use: You can only use Checkbox for security purposes and in accordance with all applicable laws and regulations.
4. Content Retrieval and Display: You can retrieve and display content from Checkbox on a mobile device, subject to the following sections.
5. Additional Terms: Some features, sections, or content in Checkbox may have additional terms. If these terms apply, they will be displayed on the screen or accessible through a link.

Prohibited Activities

Except as expressly permitted in these Terms:

1. You may not republish, redistribute, or re-transmit Checkbox in any manner.
2. Copy or store scanning results on a server or other networked storage device or create a database by systematically downloading and storing data (other than your own information) from Checkbox.
3. Remove or change any content of Checkbox (other than your own information), attempt to circumvent security, interfere with the proper operation of Checkbox or any servers on which it is hosted, or reverse engineer Checkbox.
4. Conduct vulnerability assessments, cybersecurity penetration tests, or any other action that could be reasonably considered an attack on another system using the output of Checkbox.
5. Usage of Checkbox in a manner that could harm our reputation, the reputation of our affiliates, or that of any connected entities is not allowed.
6. Use Checkbox in a way that might damage our reputation or the reputation of any of our affiliates.
7. Do other unauthorized activities that are not expressly permitted by these terms and conditions.

Intellectual Property Ownership

We provide you with a license to access and utilize Checkbox, but it's important to note that we always retain ownership of Checkbox.

All intellectual property rights related to Checkbox and its content (including text, graphics, software, images, videos, audio, trademarks, and logos), excluding your own content, belong to either us or the relevant rights holders. Except for what is explicitly outlined here, these Terms do not grant you any rights concerning the intellectual property owned by us or our licensors. It's acknowledged that accessing Checkbox or its content does not confer any ownership rights upon you.

Checkbox might incorporate code commonly referred to as open-source software, distributed under various known variations of open-source license terms. These terms encompass permissions for free distribution and modification of the software's source code, as well as the obligation for distributors to provide the source code upon request. This collection of software is collectively termed "Open-Source Software."

Please note that, if Checkbox contains any open-source software, you are only permitted to use that element under the relevant license terms of the third-party licensor (open-source license terms), not under these Terms. You agree to be bound by those open-source license terms.

Service Features and Content

We may change the design, features, and functionality of Checkbox at any time, with or without notice. However, we will not materially reduce the overall benefits of any paid service to your detriment before the end of your current subscription period.

We try to ensure that the information we provide on Checkbox is correct. However, Checkbox may also contain information from other sources, for which we are not responsible. You should not rely on any information on Checkbox without first checking with us or the original source.

We make no representations or warranties about the accuracy, completeness, timeliness, correctness, reliability, integrity, quality, fitness for purpose, or originality of any content on the application. To the fullest extent permitted by law, we exclude all implied warranties, conditions, or other terms of any kind. To the fullest extent permitted by law, we accept no liability for any loss or damage incurred as a result of you or anyone else relying on the content presented by Checkbox.

We are unable to guarantee that Checkbox or its device will be free from viruses or other potentially harmful codes. It is your responsibility to implement appropriate IT security safeguards to protect yourself and your devices.

End the Service

Right to Terminate or Suspend Access: We may terminate or suspend your access to Checkbox for any reason, including but not limited to, violation of these Terms, without notice or liability.

Surviving Provisions: All provisions of these Terms that by their nature should survive termination will remain in effect after termination, including ownership provisions, warranty disclaimers, indemnity, and limitations of liability.

Applicable Law

These Terms are governed by and interpreted under Thai law, regardless of any conflict of law principles. Our failure to enforce any right or provision in these Terms does not constitute a waiver of that right or provision. If any provision of these Terms is held invalid or unenforceable by a court of law, the remaining provisions will remain in full force and effect. These Terms constitute the entire agreement between us regarding Checkbox and supersede any prior agreements we may have had regarding the service.

Updates

We reserve the exclusive right to modify or replace these Terms at any time, in our sole discretion. If we make a material change, we will endeavor to provide at least 30 days' notice before the new terms take effect. What constitutes a material change will be determined by us in our sole discretion.

By continuing to use or access Checkbox after these changes become effective, you acknowledge your commitment to adhere to the updated terms. If you do not agree to the revised terms, please discontinue your use of Checkbox.
